TERMS & CONDITIONS

  • Company Status
    Ark Legacy Homes LLC is a fully licensed and insured company operating in accordance with all applicable state and local laws. Proof of licensing and insurance is available upon request.
  • Scope of Work
    All services will be outlined in a written estimate, proposal, or agreement prior to the start of any project. Any additional work requested beyond the agreed scope will require written approval and may result in additional charges.
  • Payment Terms
    A non-refundable deposit of 50% of the total project cost is required prior to scheduling and commencement of work.
    The remaining 50% balance is due immediately upon final completion of the project on the same day.
    • Failure to make payments as agreed may result in project delays, suspension of services, or additional fees.
  • Subcontractors
    Ark Legacy Homes LLC reserves the right to hire independent subcontractors to complete portions of the work or full scope of work. All subcontractors operate independently and are responsible for their own insurance, safety practices, and compliance with applicable laws. Ark Legacy Homes LLC shall not be held liable for the independent acts or omissions of subcontractors.
  • Materials
    We are committed to using high-quality materials to ensure durability and customer satisfaction. Material selections may vary based on availability, and substitutions of equal or greater quality may be made when necessary without prior notice.
  • Project Timeline
    Project timelines are estimates only and are subject to change due to unforeseen circumstances including, but not limited to, weather conditions, material delays, labor availability, site conditions, or other factors beyond our control. Ark Legacy Homes LLC shall not be held liable for such delays.
  • Client Responsibilities
    The client agrees to:
  • Provide clear and safe access to the worksite
  • Ensure required utilities are available (if applicable)
  • Remove personal belongings or obstructions prior to work
  • Secure pets and maintain a safe working environment
  • Failure to meet these responsibilities may result in delays or additional charges.
  • Site Conditions & Pre-Existing Issues
    Ark Legacy Homes LLC is not responsible for any pre-existing conditions, hidden damages, structural issues, or unforeseen complications discovered during the project. Any additional work required to address such issues will be subject to additional costs.
  • Liability Limitations
    To the fullest extent permitted by law, Ark Legacy Homes LLC shall not be held liable for indirect, incidental, or consequential damages. Liability, if any, shall be limited to the total amount paid by the client for the project.
  • Warranty Disclaimer
    Any warranties provided will be stated in writing. Unless otherwise specified, all work is provided “as is” upon completion. Manufacturer warranties may apply to certain materials, and it is the client’s responsibility to follow all care and maintenance guidelines.
  • Cancellations, Rescheduling & Refund Policy
    All cancellations must be submitted in writing.
    • A 50% deposit is required to secure scheduling, labor, and materials, and is strictly non-refundable under all circumstances, including client cancellation.
    • Upon receipt of the deposit, Ark Legacy Homes LLC may allocate funds toward project planning, labor scheduling, and material purchases. Therefore:
    • Deposits will not be refunded regardless of whether materials have been purchased
    • If materials have been purchased or work has begun, additional charges may apply
    • Rescheduling requests are subject to availability and approval. Rescheduling does not guarantee retention of the original project date.
    • In the event Ark Legacy Homes LLC cancels due to unforeseen circumstances, the client may be offered a rescheduled date or a refund at the company’s discretion.
    • By submitting a deposit, the client acknowledges and agrees that the deposit is non-refundable and non-transferable.
  • Change Orders
    Any changes to the original scope of work must be documented and approved in writing. Additional costs and timeline adjustments may apply. Verbal agreements will not be considered binding.
  • Indemnification
    The client agrees to indemnify, defend, and hold harmless Ark Legacy Homes LLC from and against any and all claims, damages, losses, liabilities, or expenses arising out of or related to site conditions, client negligence, misuse of completed work, or actions of third parties.
  • Governing Law & Agreement
    These Terms & Conditions shall be governed by the laws of the state in which the services are performed. By proceeding with services, the client acknowledges that they have read, understood, and agreed to these Terms & Conditions in full.
